I've been trying to resist blogging about this particular scandal for days, but as it continues to erupt I can no longer resist. Recently, the UC Davis Campus Media Board1 appointed the new California Aggie Editor-in-Chief for the 2007-2008 year: Sports Writer Eddie Lee.
Current Editor-in-Chief Peter Hamilton shortly fired sports writer Eddie Lee. The charge was plagerism. Presently, despite currently fired status, Lee is still lined up to become the next Editor-in-Chief.
Today a letter surfaced signed by 31 staff members of the California Aggie. It alleges that current E-in-C Hamilton fired Lee because he wanted Campus Editor / Features Editor Talia Kennedy (whom he is having a thinly disguised secret relationship with) to become the next E-in-C.
Additionally, in the letter, the staff demanded an explanation for over a thousand dollars that are unaccounted for from Peter & Talia's trip to the California College Media Association awards banquet, calling it "tantamount to embezzlement."
In response, Hamilton has asked for the resignation of all 31 signees of the letter.
Talia Kennedy is also noted as, while the Aggie reporter assigned to cover ASUCD, having allegedly mated with ASUCD Senator Darnell Holloway. ASUCD history repeats itself.
Incidently, the E-in-C previous to this, Matty Jojola, is the only one in known memory to have not been involved in a major shame filled scandal. Gold star for you Matty.
The unfortunate history of Aggie Editor-in-Chiefs is recounted by the illustrious former Chief Justice Fricke in the Case 29 Opinion:
In the opinion, the ASUCD Supreme Court noted that the current set-up in effect resulted in ASUCD passing the buck of authority unto the Media Board, who thereupon passed the buck to the Editor-in-Chief, leaving the E-in-C essentially unchecked and free to make the basement a kingdom unto himself (/herself).
While it wasn't the Courts place to recommend a solution to that problem, it did seem to be that a good solution would be to make the Editor-in-Chief share authority with the two most senior other editors. This way they would be prevented from firing people on a whim, getting into bad contracts that no one besides themselves think are a good idea, and the numerous other hijinks Editor-in-Chiefs have gotten themselves into lately. On any account if the Media Board had bothered to read the Court opinion I'd like to think it might have occured to them that the system needed some kind of fix.
1 The Media Board is a board of miscellenious persons from University Administration or student media organizations, to which the ASUCD government has delegated governing authority for the ASUCD-run media units (KDVS & the Aggie) in order to provide some separation between the sordid politics of ASUCD, and the sordid politics of campus media.

Swearing at the President IV
Mar. 10th, 2006 01:04 am Today I swore-in my fourth ASUCD President & Vice President. There seems to be severe inflation of farewell speeches. Once upon a time they were held in the Mee Room, where Senate takes place -- a room rated for 50 people. Then it moved to the East Conference Room (rated for 80). Sara Henry held her farewells in MU II (150). Then Gallagher moved it off to the Cabernet Room of the Silo, and now Assagai had his farewell speech in the ARC Ballrooms, rated at 400 people.
Also it was hellof catered. Y'all should have come for the food.. after all, you paid for it (well in one way or another through either ASUCD fees, state subsidies or federal subsidies, all of you except maybe ashael)
Yesterday Phi Alpha Delta had a mock trial. I was a defence lawyer. The judge was the president of the Davis mock trial team (and a member of Phi Alpha Delta), John Wheat. The defendant was accused of kidnapping Bailey. I was rather anxious since I've never done mock trial before (and no one got back to me on what part of it exactly I'd be handling until the trial had actually started), but afterwords my cross-examination was one of two actions that Judge Wheat announced as particularly good (despite the fact I only discovered I'd mostly lost my voice when I began the cross-examination! (I've been a wee bit sick))
Prosecution couldn't seem to get over the fact that Defendant Ms Tyler Perry has a wife (apparently same-sex marriage is legal in the state of Midlands). Prosecutor Sohaib invented some awesome new objections though, such as "Objection: Ridiculous!!" "Objection: Flattery!" and (against me) "Objection: badgering a child!"
Also yesterday, I bought a dozen doughnuts. Over the course of 24 hours, I ate three, flatmate Vishal ate 1, & flatmate Jason ate eight.
Now to some people this is self evident, but to others it is an utter mystery. Lest any of my readers accidently be "that roommate:" (1) generally, even if you have somewhat of an agreement to share food, you probably should not eat more than half of a particular thing of your roommate's. (2) Additionally, you probably should not either be the first to open or start eating something of your roommates, and (3) neither shalt thou eateth the last of a given something of your roommate's.
In other news: I've had to wear a suit for one reason or another every day for over two weeks now. d=

Polling Objectivity
Mar. 19th, 2005 09:12 pm So one fine day on Daviswiki, contention erupted over the shadiness factor of Campus Crusade for Christ. To help solve this controversy, Emosnail staff benevolently volunteered to do some polling on the subject, but in response noted local Republican George Andrews stated "having Fricke do a poll on Campus Crusade in EMOSNAIL is like having me do a poll on Nathan Thomas/Black Caesar/Dan Beeman Approval ratings among DCR members."
We then posted polls both here and on the UC Davis community (ucdaivs). Ostensibly this was to ascertain the shadiness factor of CCC, but really we're just using jedi mind tricks to make you think thats our motive -- the true motive was to show that CCC would get a higher shadiness rating from the UC Davis lj community than from the readers of this livejournal (the postings were exactly identical).
At this point, more than 18 hours after the polls began, and with 60 responses: the ucdavis community has rated Campus Crusade for Christ at a shadiness factor of 7.14, while the
emosnail readership has rated it at 6.33. Clearly Emosnail does not foster antireligious mentalities.
Resistentialism
The other day my browser (mozilla) inexplicably crashed and when it came back up, all my bookmarks had been lost. I find this very aggravating because I had quite a few things that I regularly used bookmarked. I miss the most-recent-pictures-updated-to-livejournal webpage that I haven't been able to find again. )=
Last night apartment-mate wdsguy came home from LA, where he spends the week steeped in the adult entertainment industry (you think I'm kidding), and promptly unplugged my internet and went to bed -- presumably without actually realizing I needed it (we don't have a router because I live in a cave so only one of us can be connected at a time). So I spent the rest of the night in the computer lounge working on my paper. When I returned in the morning I was plugged in again but our internet was down, appeared to be a problem with our service-provider. When it finally came up trillian (my AIM client) crashed and burned horribly. When I was finally able to get it up again all my friends groups had been eliminated, so I now have 435 people all in one big group. I promptly created the missing groups and garnered a small amount of satisfaction sending some people to the gulag (my friends-list category of that name anyway). I believe resistentialism is taking root in my computer. Either that or its developing bovine spongeform encephalitis ("mad cow disease").

Weekly ASUCD Shadiness Rating
We're overdue for the weekly ASUCD shadiness rating. Since last polling, ASUCD went ahead and passed unanimously the legislation preventing members of the ASUCD judiciary from authoring legislation, and Kalen Gallagher was replaced as President by Caliph Assagai and Darnell Holloway (but not before Gallagher characterized choice voting as a disease he would squash). Last night the ASUCD Senate formally concluded that Chief Justice Fricke has jedi powers. Don't expect to see an ASUCD Jedi Council being set up any time soon however -- the Senate seems to think that Fricke uses his powers for evil.
Specifically, the Senate found that ASUCD Supreme Court Chief Justice Kris Fricke managed to convince nine Internal Affairs Commissioners and twelve senators that a two line bill meant something contradictory to its actual content. To guard against the future abuse of such Jedi mind tricks, they consequently eliminated the ability of Chief Justice Fricke and the other justices to author legislation on anything other than the Court.

Swearing at the President
Also yesterday, before I was found to have Jedi powers, I swore in ASUCD President Caliph Assagai and Vice President Darnell Holloway. Their first act was to allow the recycling unit to make a presentation about Administration (non-ASUCD) plans to can their program.
Gallagher managed to make one of the few farewell speeches I've ever seen get booed, after he characterized choice voting as "a disease which is spreading from universities, which it is my personal goal to squash."
In Other News: Lebanese Prime Minister Omar Karami has been reappointed by parliament ten days after his (second) resignation. Its just not easy very easy to leave office these days is it.

Incidently, I'm making sure that everyone knows that the real reason Catherine resigned is because SPAC told her she couldn't remain the leader of MUN and not be on the SPAC forms as the leader; rather than sign the forms, she resigned. Is it really so bad to be officially listed? (note also, this isn't a complaint I raised with SPAC) It doesn't take the skills of a Jedi to fight the influence of the dark side in MUN.
PS: There's about to be another resignation.

Justice in ASUCD

Fact is, I was told to go there by my Focus [his party] advisors ... and you all sit around smiling smugly as if you didn't do the same. Not only that but I know many of you were drunk during budget hearings..." -(former) ASUCD Senator Nafeh Malik (paraphrased here, I don't have an exact transcript), resigning in lieu of the campaigning in the dorms controversy.
"wow um... I think we need a ten minute break now to recollect ourselves." -Vice President Paloma Perez. "actually... I resign as well... -(former) ASUCD Senator Sean Reul.
"The word is FUBAR" -ASUCD Senator Donald Cohen-Cutler on his cell phone immediately after a recess was subsequently called.
"I'm... not resigning..." -ASUCD Senator Brianna Haag, the third implicated new Focus senator, as an anxious silence awaits her report.
"I'm resigning... from all my other positions" -ASUCD Business & Finance Commission Chairman Alan Pang. "So wait, you're remaining in this one?" -President Kalen Gallagher, interjecting in the subsequent confusion. "yes." Room breaths an exasperated sigh of relief, Internal Affiars Commission Chairwoman Kahliah Laney looks like she's having a heart attack.
Also at yesterdays senate meeting they swore in former Focus candidate Cari Ham to fill the senate seat earlier vacated by Lead senator Adam Barr. Selection of senators to fill vacated seats is the sole discretion of the ASUCD president.

Jurisprudence in ASUCD
President Gallagher ostensably vetoed the bill passed by senate last quarter to allow ASUCD Court members to write legislation. He justified it by saying that US Supreme Court justices don't write legislation, among other things.
In response, I firstly pointed out that as the ASUCD president has until the next regularly scheduled senate meeting to veto legislation, and that has already transpired, his veto is unconstitutional. So what happens now is either the relevant government body can refuse to recognize his veto in light of its manifest unconstitutionality, or it can be reversed in a case. The former more convenient method is unlikely to occur so either I will be filing a case myself, or if I don't other people have said they will certainly file one. Obviously either way I wouldn't be sitting on the case though.
Furthermore I pointed out that in the national arena, one has the Justice Department, the Bar Association, numerous other law related lobby groups, and armies of lawyers who love to tinker with the law. In ASUCD the only semblance of any of these is the ASUCD Court. To say the court can't write legislation is to say that no judicial legislation will be written in ASUCD, and that is ridiculous.
Also I mentioned that Marberry v Madison in 1807 established that the US Supreme Court could review issues that inherently involved the Court, thus negating the opposing argument that if Court members wrote legislation it would be a conflict of interest for them. To this Commissioner Gordon "I was president of my JC" Fung responded that he didn't think Marberry v Madison applied in this situation. In response I proceeded to give a brief history of the circumstances and significance of Marberry v Madison for the Senate.
Chairperson Jenni Beeman then asked why we were citing US Supreme Court cases as relevant to ASUCD. This prompted me to give the Senate a brief overview of legal theory and jurisprudence.
In summary, it was altogether good times.
